Whistleblower Protection Laws

This is a program launched in order to prevent corruption from being done in the public sector of the department. In this program, the public is basically allowed or has the power to cross-check the functioning of the government. When they see any public official doing corruption they have the authority to write a complaint to the higher authority and they will do the investigation required in such an act and will take serious action in order to resolve this problem so that the department can function properly without any problem. This program is basically governed by the Whistleblower Protection Act, of 2011.

History-

This act's history can be traced back to the past few decades, and it has evolved a lot. But at that time there was no formal or a separate mechanism made in order to protect these whistleblower. But there were a lot of incidents of corruption, and fraud in the public department has made it essential for the government to make laws for the protection of those who have the power and courage to expose such an act of the institutions. The need was felt for such a kind of act or law because it was found that the crime rate was increasing day by day against the people who were basically trying to expose any of such activities of the institution or authorities. So, in 2004 our Supreme Court played a very important role and ordered the Central Vigilance Commission to act as a medium in order to receive the complaints given by the whistleblowers and also have to provide them protection after that, this CVC role a temporary relief was granted to the public but in 2010 a bill was proposed before the parliament to make a separate act for the protection of Whistleblower and then after several years of deliberation the bill was passed by the parliament which was known as the Whistleblowers Protection Act, 2014.

 

Role of Whistleblower-

A very important role is played by the whistleblower in maintaining the fine working and integrity of the organization and also for the protection of the interest of the public. The public has the authority or power to reveal the misconduct any fraudulent activity or any kind of threat to public safety. The whistleblower basically put the light on such a small issue that was not seen by the government and with the help of such a person the fraud can be stopped and that department can function properly without any issues. These person basically risk their life, reputation, and their job in order to just bring the fraudulent activities out of the public institutions. So that others can enjoy their right and facilities which have been provided by the government properly and uniformly.

 

Future of Whistleblower Protection Act-

With the increasing rate of awareness in the governmental institution the protection for the whistleblowers will also increase day by day as a serious human health and safety issue. The UN and other International organizations and trying to make a stronger and safer platform on which the whistleblowers can register their complaints properly without having the fear of exposure before the society in their mind. From this, they will work and act more properly and effectively just to ensure the proper working of the public institutions. The government along with the other organizations must try to make such a friendly environment so that the employees can feel safe and secure in such a type of environment. This will also be beneficial for the whistleblower because there will be a transparent culture which will overall ensure the integrity of the organization and also its proper functioning. As with the changing society, there is also the need to extend the working and effects of this Act to the private sector so that the people working in the private sector can also be protected under this act. So that if there is any kind of unethical activity in the institution whether it is public or private the whistleblower can properly register any of the complaints if required within the particular platform and see its results.

 

Conclusion-

 This law has been very lately recognized but there was the need for such a kind of law from the very start of the companies so that the person or the particular individual who exposes any of the kind of fraudulent act of the company can be protected by laws from any kind of danger to his life. Until now the Whistleblowers Protection Act, of 2014 has been a landmark law but some of its provisions have been weakened due to restricted coverage in an area or other reasons. It is essential for India to make this law more powerful in order to cover vast areas and sectors so that there can be strong enforcement of such laws so as to ensure the confidentiality and safety of the whistleblowers overall in the country.
